Terms of Sale

These Terms of Sale govern your purchase of HookBoss™ products from Romark Industries, Inc. ("Romark," "we," "us") through hookboss.net, and your use of this website. By placing an order, you agree to them.

1. Who you're buying from

Products sold on hookboss.net are sold by Romark Industries, Inc., an Ohio corporation located at 20545 Center Ridge Rd., Ste 205, Rocky River, OH 44116. HookBoss™ is a Romark Industries brand.

2. Orders and acceptance

Your order is an offer to buy. We accept it when we ship the product. We may refuse, limit, or cancel any order — including for suspected fraud, pricing or description errors, product unavailability, or quantities that appear to be for resale where we haven't agreed to wholesale terms. If we cancel an order you've already paid for, we'll refund it in full.

3. Pricing, taxes and errors

Prices are in U.S. dollars and may change at any time before you place an order. Applicable sales tax is calculated at checkout. While we work to keep the site accurate, typographical, pricing and product-description errors happen; we reserve the right to correct them and to cancel any affected order, even after it's been submitted.

4. Payment

Payment is processed by Stripe. By submitting payment information, you represent that you're authorized to use the payment method and you authorize us to charge the full order amount, including tax. See our Privacy Policy for how payment information is handled.

5. Shipping, title and risk of loss

Shipping terms, timing and free-shipping eligibility are described in our Shipping Policy. Title and risk of loss pass to you when we deliver the product to the carrier. Delivery dates are estimates, not guarantees, and we're not liable for carrier delays.

6. Returns and exchanges

Returns and exchanges are governed by our Returns & Exchanges policy. In summary: product must be new, unused, and in its original box; returns ship prepaid; we reimburse shipping only if we shipped the wrong part or the product is defective; and the buyer covers replacement freight on exchanges.

7. Product use and safety

HookBoss float hooks are designed to hold concrete floats and similar hand tools on a belt, bucket, rail, or bull float handle. They are not personal protective equipment. They are not designed, tested, rated or sold for:

• fall protection, climbing, or supporting or arresting a person;
• lifting, hoisting, rigging, towing or overhead load-bearing;
• any life-safety application; or
• any use outside the product's intended purpose and posted specifications.

You are responsible for inspecting the product before each use, using it appropriately for the task, and following all applicable jobsite safety rules, OSHA requirements, and employer policies. Do not modify, cut, drill, heat or alter the product.

8. Limited warranty

Romark warrants that HookBoss products are free from defects in materials and workmanship under normal use in their intended application. If a product is defective, your exclusive remedy is, at our option, replacement of the product or a refund of the purchase price. To make a claim, contact us at info@romarkindustries.com with your order number and a photo of the product.

This warranty does not cover normal wear, cosmetic marks, or damage resulting from misuse, abuse, modification, alteration, improper installation, use outside the intended application, or use in any of the applications excluded in Section 7.

9. Disclaimer of other warranties

Except for the limited warranty in Section 8, and to the fullest extent permitted by law, the products and this website are provided "as is," and Romark disclaims all other warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose. Some states do not allow the exclusion of implied warranties, so this may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, Romark's total liability arising out of or related to any product or these terms will not exceed the amount you paid for the product at issue. Romark will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost time, project delays, or damage to tools, equipment or work in place, even if we've been advised of the possibility. Some states do not allow certain limitations, so parts of this may not apply to you.

11. Trademarks and content

HookBoss™, ForteFlex™, the HookBoss logo, product images, copy, and other site content are the property of Romark Industries, Inc. and are protected by trademark and copyright law. You may not copy, reproduce, or use them without our written permission.

12. Use of this website

You agree not to use this site for any unlawful purpose, to interfere with its operation or security, or to scrape, harvest or copy its content for commercial use. We may suspend access for misuse.

13. Wholesale and distributor purchases

Wholesale, distributor and bulk purchases may be governed by separate written terms, pricing and freight arrangements. Where those terms conflict with these, the separate written agreement controls.

14. Governing law

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Cuyahoga County, Ohio, and you consent to their jurisdiction.

15. Changes to these terms

We may update these terms at any time. The version in effect when you place your order applies to that order. The "last updated" date at the top of this page shows when these terms were last revised.
